If you rent a car with illegal tint, the ticket is on the driver, not the rental company. Here is how major U.S. rental agencies handle tint liability, and what to do if the car is illegal in your state.

The driver is liable, not the rental company

Every major U.S. rental car contract — Hertz, Avis, Enterprise, Budget, National, Turo — includes language that transfers all traffic citations to the renter during the rental period. A tint ticket you receive while driving a rental is your ticket, not the rental company's.

This applies even if the vehicle was illegally tinted when you picked it up from the rental counter.

What to do if the rental has illegal tint

  • Check before driving off. If the windows look unusually dark, ask the rental counter for a different vehicle.
  • Document. Photograph the windows at pickup. Note the VIN. This protects you if the rental company later tries to charge you for tint that was already installed.
  • Do not install additional tint. The contract prohibits any vehicle modification; installing film would be contract breach.
  • Ask for a note on the rental agreement. Many companies will annotate the agreement if the vehicle is non-compliant, which helps contest a ticket later.

Out-of-state tint on rental cars

Rental fleets are usually maintained at a specific regional depot. A car from an Arizona depot may have darker tint than the California rental rules permit. If you rent in Arizona and drop off in California, that Arizona tint can get you ticketed during California driving.

Turo and peer-to-peer rentals

Turo and similar platforms add a wrinkle: the owner selects the tint, not a fleet operator. Many privately-owned Turo vehicles carry state-lenient tint that is illegal elsewhere. Always confirm with the owner and photograph before driving off.

Can I refuse a rental car because of illegal tint?

Yes. Every major rental company will swap a vehicle at pickup if you cite a legitimate concern. Do it at the counter, not after driving off.

Who pays if I get a tint ticket in a rental?

You do. Rental contracts transfer all traffic citations to the renter. Rental companies will also add a service fee (typically $25–$50) for administrating the violation on their end.

Does Turo cover tint tickets?

No. Turo’s insurance policies do not cover traffic violations. Tickets are the driver's responsibility just like with a traditional rental.
